This website is the property of Recordalife (Kiriad Research Limited), referred to as “Recordalife” and is made available solely on the terms and conditions set out below. Use of the website constitutes an agreement by the user to be bound by these terms and conditions.
Recordalife accepts no responsibility for any loss or damage which may arise from reliance on information contained in this site or on any other websites to which this site may at any time be linked.
Recordalife cannot guarantee that any downloads from this site are free of viruses or other harmful material and you are strongly advised to ensure that your own anti-virus and protective software is up-to-date and effective.
Users of this website are not permitted to upload to this website or to transmit any material which will cause damage to the performance of any computer system or any material which is obscene, defamatory or in breach of any copyright or intellectual property rights.
Reproduction or use of any material from this website is not permitted except where licensed to do so by Recordalife.
Definitions and Interpretation
Unless the context otherwise requires, references to the singular include the plural and references to the masculine include the feminine, and vice versa.
The headings contained in these terms and conditions are for convenience only and do not affect their interpretation.
References to any statute or statutory provision shall, unless the context otherwise requires, be construed as a reference to that statute or provision as from time to time amended, consolidated, modified, extended, re-enacted or replaced.
In these terms and conditions the following terms are given these meanings :-
“Client” the party ordering the packages or materials from the Company.
“Company” Recordalife is the trading name for Recordalife (Kiriad Research Limited) which is a registered in England & Wales number 07124576.
“eBook” an electronic version of your “My Life Story” in PDF and mobile formats including iPad and Kindle.
“Fee” the agreed payment to be paid by the client to Recordalife for the package or materials as set out in accordance with the website terms and conditions.
“Gift certificate” the initial purchase includes a gift certificate which is redeemed when first logging in and booking the interview. The certificate expires 12 months after first order. The expiry date is on the certificate.
“Life Recorders” the interviewer who will conduct the interview via Skype or phone call. There is no guarantee as to the availability of a particular interviewer who will be allocated by Recordalife.
“Materials” any part of a package provided or additional items ordered including CDs, USBs or printed copies of the client’s ‘My Life Story’.
“Package” the Recordalife Life Story Pack including a presentation box with high quality hardback book containing the client’s personal life story (from an interview of 60-90 minutes), with supplied photos, CD and MP3 USB stick with audio recordings of the client’s voice.
“Recordalife Extra” the Recordalife Life Story Pack including a presentation gift box with 4 copies of the client’s high quality hardback book containing the client’s personal life story (from an interview of 120-150 minutes), with supplied photos, eBook version, CD and MP3 USB stick with audio recordings of the client’s voice.
“Recordalife Personal History” the Recordalife Life Story Pack including a presentation gift box with 2 copies of the client’s high quality hardback book containing the client’s personal life story (from an interview of 60-90 minutes), with supplied photos, eBook version, CD and MP3 USB stick with audio recordings of the client’s voice.
“Service” the service to be provided by Recordalife over the agreed period in the contract.
“Welcome Pack” includes the gift certificate to redeem in return for a package from Recordalife, and Welcome Guide.
Amendments to Terms
Recordalife may revise these terms and conditions of use at any time and update this information. You should therefore verify this page regularly and review the full terms and conditions. Your continued use of the website constitutes your agreement to these terms and conditions as amended.
The cost of a package shall be the price listed at the date of purchase (subject to any discount codes as agreed with the Company). The listed price is inclusive of VAT. Any other taxes applicable may be charged as permitted by UK legislation.
The price of a package is subject to change at any time at the Company’s sole discretion prior to the date of purchase. You must check the website for the current prices before ordering any package.
Recordalife price lists shown on the website do not constitute legally binding offers. Recordalife is under no obligation to accept your order for any package at any time. Acceptance of your order shall take place only when your order is confirmed to you.
Failure to make payment in accordance with these terms may incur extra charges and any issues of non-payment will be passed on to our legal representatives.
Payment for all online packages shall be made by online payment methods through PayPal or as may be specified by Recordalife. Payment for all packages shall be made in pounds sterling.
Recordalife does not hold details of any of the credit or debit cards used for transactions on the website. You should check with the relevant credit card company and PayPal if you have any concerns. Payment by these methods will be subject to their own privacy and data collection practices. Recordalife has no responsibility or liability whatsoever for these independent practices.
Payment for packages or materials can be made directly to Recordalife by calling our office on +44 (0)20 8123 5470.
Recordalife does not retain details of any of the credit or debit cards used for transactions by telephone. Recordalife retain the right to ask for further detail to verify a client’s identity. Details are only held for processing at the time of the call. All data is held in accordance with the Data Protection Act 1998.
Validity of Packages
Packages are valid for redemption at any time within the 12 months from the date of the purchase of the order or gift certificate.
Delivery of Packages
We will endeavour to deliver a gift box package within 3 working days of ordering from the website.
We aim to deliver completed packages of the Recordalife Life Story with the printed book within 21 days from a client’s approval of the draft book. All packages are delivered by courier and tracked. Details of tracking will be emailed to the registered client as soon as despatched.
Packages, books and audio recordings will only be delivered to the client or any delegated recipients.
You have the right, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations, to cancel any distance contract made with us, which includes contracts made exclusively by means of online purchase, e-mail, fax, telephone or other means of distance communication provided notice of cancellation is received by the company before the redemption of a gift certificate, whether by telephone or online or at the latest 14 days beginning with the day after the day on which the purchase was made, provided that redemption has not taken place or any services booked. You will not be able to cancel the package once delivery of the services has begun.
In the event that a package is cancelled pursuant to the Regulations, you will be responsible for returning any Materials to us in accordance with our returns procedure.
Recordalife will accept Materials for return only if
- You cancelled the relevant distance contract within the 14 days beginning with the day after the day on which the purchase was made, provided that redemption has not taken place or any services arranged
- The materials were not compliant with our obligations under these terms and conditions
- You follow the returns procedure set out below.
Materials must be accompanied by a valid proof of purchase, and complete and unused.
Recordalife reserves the right not to make any refund in respect of sealed materials where such seal has been broken.
If you qualify for a return and have followed the above procedure, you will receive a full refund of the purchase price and the outbound delivery charge to be credited to the card or account used for the initial purchase.
Gift certificates must be redeemed by the date on the certificate (12 months from date of order). An additional fee may be charged to revalidate certificates that have expired at the sole discretion of Recordalife. This will take into account any changes in the cost of packages and the administration required. Recordalife reserve the right not to accept certificates that have expired.
Secure Client Login
Details of access to the client login is given once a package has been purchased. Clients are responsible for arranging the interview either though the online booking or by telephoning Recordalife on +44 (0)20 8123 5470. Interviews are arranged at a time that is convenient to the client, within the available hours of Life Recorders.
Extra books and CDs can be ordered via the client login using the unique client number as notified to the client by Recordalife.
Uploading to the Client Area
Clients can upload up to 20 photos, images or art for inclusion in the hardback printed book, to the client area. It is the client’s responsibility to ensure that all images are named and described. Images included in the printed book will appear with a caption and will be reproduced in full colour, although black and white photos are also accepted.
It is the client’s responsibility to ensure that any material uploaded is legal and that they have the necessary consent and permissions for use.
Recordalife reserve the right to make reasonable modifications to images provided to ensure that they meet Recordalife’s printing specifications, however, Recordalife will not retouch images or manipulate images except to meet printing specifications. Recordalife reserve the right to select suitable images from those uploaded and do not guarantee to include all images.
Information about a client’s life story and family, to be included in the packages, will be obtained from details given during the interview process. This will follow the Recordalife interview process and include following a questionnaire. The interviewer is provided by Recordalife and will adapt the interview at their discretion as they see appropriate. An individual interview will usually take between 60 and 90 minutes, although the client may wish to take a short break during the interview. Recordalife Extra packages include 2 interviews, totaling between 120 and 150 minutes during which the client may specify areas which they wish to speak about in more detail.
Interviews can be held with clients based in any part of the world, subject to making suitable communication arrangements.
Interviews will be transcribed into text, edited and proof read by Recordalife at their discretion. The packages will not include the interview verbatim. An electronic file in PDF format is prepared by Recordalife and proof read for a second time. This is then sent to the client by email in PDF format for comment and approval.
Recordalife will not be liable for any views expressed in the interview or produced in the book or audio recordings. Swearing or profanity will not be included in the books or audio recordings.
Recordalife will provide a draft eBook in PDF format for the client to approve and any changes or amendments must be requested at this stage. A draft eBook will usually be sent within 3 weeks of the interview. Whilst Recordalife will take into account the wishes of clients, we reserve the right to edit the eBook and printed copy to meet printing specifications.
Interviews will also be burnt onto CD, as well as being provided as an electronic file on USB stick and for download. Call quality will vary depending on the communications method used and location in the world of the interviewee. As such, no guarantee is provided in terms of the sound quality of the interview other than Recordalife will endeavour to provide a quality interview within these limitations.
Recordalife packages include the option for clients to speak in their native tongue with an English translation included in the printed book. We cannot guarantee the availability of this in all languages. Clients are required to contact us directly (call +44 (0)20 8123 5470) to make an enquiry prior to purchasing any of the packages. Where available, qualified linguists will conduct interviews in a client’s mother tongue.
Recordalife is the owner and/or authorised copyright licence holder of the logos, trademarks and content present on this website. By posting this information on our website we do not grant any licence, copyright or use of any other of our intellectual property rights to any third party.
You acknowledge that you do not own and shall not acquire any title, copyright or any other intellectual property rights in relation to the website and you shall not modify, translate, adapt or otherwise amend the contents.
The Recordalife format and interview is copyright of Recordalife (Kiriad Research Limited).
After delivery of your package, the copyright of the Life Story is assigned to the interviewee. Further printing or distribution of the book, audio or other materials can only take place with the agreement of both parties. The company will maintain copies of all the files used in connection with your package for a reasonable time (usually at least one year) and all data will be held securely in accordance with the Data Protection Act.
The interviewee will own, or have express permission to use, the text files, images, graphics and any visual elements, video or sound bites, that you may have sent to us to use in connection with the package.
Your information will be handled with the upmost confidence. Recordalife will adhere to all national and EU data protection, data transfer, data retention, and confidentiality regulations and always stores data sent to us in a secure manner.
All information that you send to us will be kept confidential and will not be given to any unauthorised third parties except as required by law.
We will only send your package to the address that you have designated and will not print or distribute your book unless you place additional orders for materials or packages with us.
Under Data Protection legislation all individuals have the right to access their personal data and when processing data on your behalf we will comply with the provisions of the Data Protection Act 1998. We are registered with the Information Commission Office, UK data protection number ZA264904. The Data Controller is Michael Tapia.
Use of the website
The information and services available on the Recordalife website are provided for the purpose of assisting those with an interest in purchasing services from the Company, with information on the provision of services and the ability to purchase packages and make enquiries. Users are granted a limited license to use the site that is non-transferable and may be revoked by Recordalife at any time and for whatsoever reason.
The material available on this website is not for commercial use by other parties. You are not permitted to decompile, reverse engineer, disassemble, rent, lease, loan, sell, sublicense, or create derivate works from the site or the content. The use of network monitoring or discovery software to determine the site architecture, or information about its usage or identify individual users is strictly prohibited.
Recordalife accepts no responsibility for the content or accuracy of the information that is available, or is posted on this website.
Recordalife in its sole discretion shall determine your compliance with the above and shall have the right to block access to any user, or delete from this website without any prior notice, any material that it deems not to comply or to be objectionable for any reason.
Recordalife will not be liable to users or any third party for any damages whatsoever, whether direct, indirect, incidental or consequential relating to or arising out of a visitor’s use of this website.
Users of this web site must not:
- Disrupt or interfere with the security of the site or otherwise abuse any service provided on the site or linked website.

In order to access and use the client area of the website you are required to purchase the appropriate package from the shop and complete the payment details. The user is responsible for ensuring that the information given is current, complete and accurate. The purchase of a package from Recordalife is subject to acceptance or refusal by Recordalife at its sole discretion. By purchasing packages or materials from this website you warrant and represent that you can form binding contracts under applicable law.
You are solely responsible in all respects for protecting the confidentiality of any password given to you or selected by you for access to or use of the website. Your password may only be used by you personally and you must not share it with or transfer it to any third parties. You are solely responsible for any and all activities that occur under your password and account.
You must notify Recordalife immediately of any unauthorised use of your password or any other breach of security regarding the website which comes to your attention. Recordalife will not be liable for any loss that you may incur as a result of a third party using your password or account. However, you may be liable for losses incurred by Recordalife as a result of someone else using your password or account.
Recordalife warrants that the packages and the website shall be provided with reasonable skill and care by qualified and experienced consultants, and that the materials will be of satisfactory quality and compliant with any sample materials supplied to you.
No warranty is given that a package or materials supplied under these terms and conditions shall be fit for any particular purpose. Your statutory rights as a consumer (if any) are not affected by these terms and conditions.
Recordalife will endeavour to make the website and packages available, but cannot guarantee that the website will operate continuously or without interruptions which could affect use of the website.
The website may contain links to other sites, which are not under the control of Recordalife. We accept no responsibility or liability for the content, security, availability and privacy practices, or any material on any website that is not under the control of Recordalife.
A link to a third-party website does not imply endorsement.
Changes to Packages
Recordalife reserves the right to alter or cancel any part of a package prior to delivery of that package.
The website is provided for general information and do not constitute financial, legal or other professional advice. Recordalife does not accept any responsibility or liability for any loss which may arise from reliance on information contained on the website.
Recordalife, its affiliates and business partners each reserve copyright in all content that they provide to the site, including but not limited to design, text, software, drawings, graphics and other files. None of these may be republished, reproduced, downloaded, displayed, distributed, posted transmitted or sold in any form or by any means in whole or in part without prior written permission of the copyright owner.

Parties to these terms and conditions shall not be liable for any failure or delay in performing their obligations where such failure or delay results from any cause that is beyond the reasonable control of that Party. Such causes include, but are not limited to: power failure, internet service provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event that is beyond the control of the Party in question.
In the event of termination due to force majeure, the Parties shall agree upon a fair and reasonable payment for all Services provided up to the date of termination. Such payment shall consider any prior contractual commitments entered into in reliance on the performance of the Agreement.
No failure or delay by either Party in exercising any of its rights under the Agreement shall be deemed to be a waiver of that right, and no waiver by either Party of a breach of any provision of the Agreement shall be deemed to be a waiver of any subsequent breach of the same or any other provision.
The Agreement contains the entire agreement between the Parties with respect to its subject matter and may not be modified except by an instrument in writing signed by the duly authorised representatives of the Parties.
Each Party shall acknowledge that, in entering into the Agreement, it does not rely on any representation, warranty or other provision except as expressly provided in the Agreement, and all conditions, warranties or other terms implied by statute or common law are excluded fully permitted by law.
The Agreement may be entered in any number of counterparts and by the Parties to it on separate counterparts each of which when so executed and delivered shall be an original, but all the counterparts together shall constitute one and the same instrument.
If one or more of the provisions of these terms and conditions is found to be unlawful, invalid or otherwise unenforceable, those provision(s) shall be deemed severed from the remainder of these terms and conditions and shall remain enforceable.
Nothing in these terms and conditions shall constitute or be deemed to constitute a partnership, joint venture, agency or other fiduciary relationship other than the contractual relationship expressly provided for in these terms and conditions.
No part of these terms and conditions shall confer rights on any third parties and accordingly the Contracts (Rights of Third Parties) Act 1999 shall not apply.
Access to the client area of the website shall be personal to the user. The user may not assign, mortgage, charge or sub-license or otherwise delegate any of its rights, or sub-contract or otherwise delegate any of its obligations without the written consent of Recordalife.

Jurisdiction and Governing Law
These terms & conditions and all disputes, whether contractual or otherwise, arising out of or in connection with them are governed by and shall be construed in accordance with the laws of England and Wales and each party submits to the exclusive jurisdiction of the English courts.
